OF SALE

This letter is an attempt to collect a past due debt. Any and all information obtained will be used in the collection process. If you have any questions about your rights in this matter you should contact your attorney.

Reference is made to that certain trust deed made by Deann M. Bollinger, as grantor, to Wallowa Title Company, as trustee, in favor of Elaine Keleman, as beneficiary, dated January 5, 1998, recorded January 7, 1998, in the mortgage records of Wallowa County, Oregon, in book/reel/volume No. __ at page __, or as fee/file/instrument/microfilm/reception No. 9834878, covering the following described real property situated in said county and state, to wit:

Lot 12, Block 4, MAGILL AND COLE ADDITION, to the Town of Lostine, Wallowa County, Oregon, as shown by the plat thereof on file and of record on the Office of the County Clerk of said County and State in Book 1 of Deeds, Pages 468 and 469 (Dedicated as Cole and Magill Addition by Deed recorded on Book 50 of Deeds, Page 28).

Both the beneficiary and the trustee have elected to sell the said real property to satisfy the obligations secured by said trust deed and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.735(3); the default for which the foreclosure is made is grantor's failure to pay when due the following sums:

Monthly principal and interest installments of $298.71 each, beginning 05-02-02 until paid; delinquent property taxes, if any; cost of foreclosure report; attorney's fees, together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made the Beneficiary as allowed by the Note and Deed of Trust.

By reason of said default the beneficiary has declared all sums owing on the obligation secured by said trust deed immediately due and payable, said sums being the following, to wit:

The principal sum of $4,145.71 with interest on the principal balance at the rate of 9 percent per annum from 05-05-02, until paid; costs of foreclosure report; attorney's fees together with any other sums due or that may become due under the Note or by reason of this foreclosure and any further advances made by the Beneficiary as allowed by the Note and Deed of Trust.

Wherefore, notice is hereby given that the undersigned trustee will on May 20, 2003, at the hour of 1:00 o'clock, p.m., in accord with the standard of time established by ORS 187.110, at Wallowa County Title Company, 109 SE First Street, in the City of Enterprise, County of Wallowa, State of Oregon, sell at public auction to the highest bidder for cash the interest in the said described real property which the grantor had or had power to convey at the time of the execution by him of the said trust deed, together with any interest which the grantor or his successors in interest acquired after the execution of said trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that any person named in ORS 86.753 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by rendering the performance required under the obligation or trust deed, and in addition to pay said sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with trustee's and attorney's fees not exceeding the amounts provided by said ORS 86.753.

In construing this notice, the masculine gender includes the feminine and the neuter, the singular includes the plural, the word "grantor" includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by said trust deed, and the words "trustee" and "'beneficiary" include their respective successors in interest, if any.

An execution issued from this court in this case on February 21, 2003, pursuant to a judgment rendered and entered on February 13, 2003 in favor of plaintiffs, Kenneth E. Stein and Patricia M. Stein, Trustees of the K&P Stein Trust, and against defendants Daniel Roberts and State of Oregon. The execution issued pursuant to the judgment commanded me to sell the real property described below to satisfy the judgment against Daniel Roberts, defendant, in the sum of $17,575.69, plus interest thereon at the rate of 9.0 percent from April 20, 2002, until the date judgment was entered, costs and disbursements in the sum of $192.00, attorney fees in the sum of $2,029.00, plus interest on said sums at the rate of 9.0 percent from February 13, 2002, until paid. I will on April 1, 2003, at 10:00 a.m. at the entrance to the county courthouse in Enterprise, Wallowa County, Oregon, sell at public auction (subject to redemption as provided by law) to the highest bidder for cash, all the interest that defendant Daniel Roberts had on February 13, 2003, the date judgment was entered and all the interest that defendant Daniel Roberts had thereafter, in the following described real property:

Notice is hereby given of a regular meeting to be held by the Wallowa County Planning Commission on Tuesday, March 25 at 7 p.m. in the Courtroom of the Wallowa County Courthouse. The agenda for this meeting will include, but is not limited to, adoption hearings on major amendments to the Wallowa County Comprehensive Land Use Plan and Land Development Ordinances relating to:

AMD #03-02 - Task 4 Wallowa Lake Community & Residential Recreation Zone

Revise the Comprehensive Plan to include new findings, policies, plan designations, and zoning for the unincorporated resort community of "South Wallowa Lake." Revise the zoning ordinance to implement new policies and unincorporated community rules for the South Wallowa Lake Unincorporated Resort Community and implement new rules limiting creation of new parcels to a minimum of two acres for rural residential lands for lands zoned "Residential Recreation (R-2)" not within the boundary of the community boundary.

This matter will be reviewed for conformance to the Wallowa County Comprehensive Land Use Plan and Land Development Ordinances and any other applicable goal, regulation or ordinance of Wallowa County or the State of Oregon. Applications may be reviewed in the Planning Department. Written comments must be received by the Wallowa County Planning Department - 101 S. By virtue of a Writ of Execution issued out of the Circuit Court of the State of Oregon for the County of Wallowa, in the case of Dolly Geneva Wilms, Trustee of Trust Agreement dated 12/10 82, Henry W.
