NOTICE IS HEREBY GIVEN that the undersigned has been appointed personal representative of the above estate.

All persons having claims against the estate are required to present them to the personal representative at P. O. Box E, Enterprise, OR 97828, within four (4) months after the date of first publication of this notice or the same may be barred. Information to any interested persons may be obtained from the records of the Court or the personal representative.

NOTICE OF WATER RIGHT TRANSFER 7742

Norman Werst filed an application with the Water Resources Department for an additional Point of Diversion of water as provided by ORS 537.705 and ORS 540.510 to 540.530.

Certificate 9125, in the name of George F. Werst and Hugh Dougherty, includes a right limited to 2.5 cubic feet per second from Wallowa River, with a priority date of July 16, 1926 for Irrigation and Domestic.

Certificate 45005, in the name of Norman Werst, includes a right limited to 0.96 cubic feet per second from Wallowa River, with a priority date of July 12, 1968 for Irrigation and Supplemental Irrigation.

Certificate 45008, in the name of Thomas G. Scott, includes a right limited to 0.76 cubic feet per second from Wallowa River, with a priority date of February 2, 1972 for Irrigation.

The point of diversion for these rights is 670 feet S and 990 feet E from the NW corner of SW1/4NW1/4 Section 11, being in the SW1/4NW1/4; Section 11, T 1 N, R 42 E, WM.

The applicant proposes to add a point of diversion located 850 feet E and 300 feet S of S1/4 corner Section 3; being within the NW1/4NE1/4, Section 10, T 1 N, R 42 E, WM.

Protests may be filed by persons who think their water right may be injured by this change. Additional information or forms and rules for filing protests are available from the Water Resources Department by calling 541-378 8455. If a protest is filed a hearing may be held.

The last date of publication is July 3, 2003. IF NO PROTEST IS FILED BY AUGUST 2, 2003, THE CHANGE MAY BE APPROVED WITHOUT A HEARING.

NOTICE OF PUBLIC HEARING

The City of Enterprise will hold a public hearing on Monday, July 14, 2003 at their regular Council Meeting at 7:30 p.m. to consider vacating a total of 30 feet of Silver Street. Silver Street currently is 90 feet wide. The request is to vacate 15 feet on the north side and 15 feet on the south side of Silver Street, the whole length of the street. All interested persons are invited to attend or mail written comments to City of Enterprise, 108 N. E. First St., Enterprise, OR 97828.
